Nintendo ferma una pericolosissima campagna Kickstarter
Non so se avete presente cosa siano i Visual Compendium. È una serie di libri dedicati al passato dei videogiochi, in cui macchine specifiche vengono raccontate soprattutto attraverso l’uso di immagini, con interviste e brevi articoli di accompagnamento. La collana, curata da Sam Dyer, è nata su Kickstarter e ha già visto l’uscita di volumi dedicati a Commodore 64, Amiga eZX Spectrum. Il prossimo volume previsto è quello dedicato al NES/Famicom e, prevedibilmente, la campagna ha raccolto in breve tempo una valanga e mezzo di soldi. Enter Nintendo, che ha scatenato i suoi avvocati e fatto bloccare la campagna. In un messaggio arrivato stamane ai backer, Dyer spiega che prima di avviare la raccolta fondi ha consultato avvocati per assicurarsi di stare facendo le cose a modino secondo le regole del fair use e ha sentito anche gente di Nintendo UK. Inoltre, dopo il fattaccio, ha eseguito un paio di ritocchi per sicurezza. Ora si attende che la revisione della cosa venga completata, nella speranza che tutto si concluda con un nulla di fatto.

Description of infringing material: This Kickstarter project makes unauthorized use of Nintendo’s copyrights as noted above. The description of the book states that it is “mainly visual”, and the campaign shows pages of the book which consist simply of large screenshots copied directly from Nintendo’s video games. This campaign also makes use of a mark that is confusingly similar to registered trademarks owned by Nintendo. Specifically, the project’s creator is using a modified version of Nintendo’s “Official Nintendo Seal” mark (protected by U.S. Trademark Registration Nos. 3114368 (Class 16), 3117154(Class 28), 3173562(Class 9), and 1570911(Classes 16 and 28)) and Nintendo’s “Original Seal of Quality” mark (protected by EU Trademark Regisration No. 3475977 (Classes 9, 16, 28) to promote this project. This use of Nintendo’s intellectual property may confuse Kickstarter backers into thinking this project is sponsored or licensed by Nintendo, when in fact it is not.”
Che dire... grazie a Nintendo che ci protegge dal rischio di confonderci e pensare che sia lei a produrre il libro. Abbiamo schivato un proiettile. Aggiungo che, per fortuna, se/quando la campagna verrà sbloccata, ripartirà esattamente da dove si è interrotta, senza quindi perdere giorni per la raccolta fondi. Speriamo bene.
